The 2019 Petzbe Sweepstakes (or name of Sweepstakes) Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
SWEEPSTAKES VOID WHERE PROHIBITED.
1. Eligibility: The Sweepstakes (“Sweepstakes”) is open only to those who have signed up through the Petzbe App and completed all four (4) challenges in the app between the dates of April 3, 2019 and April 28, 2019. All participants must be at least 13 years of age as of the date of entry. The Sweepstakes is only open to legal residents of the UK and is void where prohibited or restricted by law, rule or regulation. Employees of NBC Universal (“Prize Supplier”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable UK law and regulations, including but not limited to the Gambling Act 2005.
2. Agreement to Rules: By participating, you accept and agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth in the rules. In addition, you agree to accept the decisions of Petzbe, Inc. (“Petzbe”) and NBC Universal, as final and binding as it relates to the contest. The Sweepstakes is subject to all applicable laws and regulations.
3. Sweepstakes Period: The Sweepstakes begins at 9:00AM EDT April 3, 2019 and ends April 28, 2019 at 11:59PM EDT (“Promotion Period”). Entries received prior to or after Promotion Period are disqualified.
4. How to Enter: The only way to enter the Sweepstakes is through the Petzbe App, which is free to download (add link) during the Promotion Period. No other method of entry is accepted. Limit one (1) entry per person, per email address and per household. The Sweepstakes must be entered by completing a minimum of one (1) post for each of the four (4) challenges. Additional posts do not increase chances of winning and will be void. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Petzbe. Any attempt by a person to enter more than once with multiple email accounts may result in disqualification at the discretion of Petzbe. upon verification of the prize winner. All online entries must be received by 11:59 p.m. EDT on April 28, 2019. It is your responsibility to ensure timely submission of entries. No submissions will be accepted after the deadline for any reason. The sole determinant of time for the purposes of online entries will be Petzbe’s server machine(s) located in the EDT zone. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or attempt to circumvent the rules you will be disqualified, and all your entries may be removed from eligibility at the sole discretion of Petzbe.
Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry through the Petzbe App. The "authorized account holder" is the natural person assigned to the e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Petzbe. with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. Prize will only be awarded to the authorized account holder.
5. Use of Data. Petzbe and the Sponsor will collect personal data about participants, including without limitation your email address and birthday to confirm age and identity, and your pet’s name, gender, species and breed and birthday, etc. Winners are required to provide their name and mailing address to receive prizes. By submitting an entry you hereby acknowledge and agree to all personal information uses and disclaimers included in Privacy Policy of Sponsor available at: https://www.nbcuniversal.com/privacy and Petzbe, Inc. available at: https://petzbe.com/privacy. You further acknowledge and agree that Sponsor and Petzbe are entitled to use your personal data provided in all entry forms in accordance with these Privacy Policies. You will be given the option to receive commercial e-mails, messages through the Petzbe app and promotional materials, but eligibility to participate in the Sweepstakes is not dependent upon your consent to receive such e-mails, messages through Petzbe app and promotional materials. Notwithstanding anything to the contrary Sponsor’s or Petzbe’s privacy policies, you grant to the Sponsor and Petzbe and the Sponsor and Petzbe reserve, the right to use any and all information related to the Sweepstakes, including information you provide in connection with the Sweepstakes, for any purpose, unless prohibited by law.
5. Prizes: Winners will receive an illustrated Secret Life of Pets 2 posters (digital and framed versions) that features your pet alongside the Secret Life of Pets 2 characters. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all income or other taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Petzbe and NBC Universal to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
If in Petzbe’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Petzbe reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Petzbe reserves the right to award prize in a random drawing from all eligible entries received before the time of cancellation. Petzbe in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified.
You may be required to sign a release, which grants the Sponsor and Petzbe the right to use and publish your proper name online or in any other media in connection with the Sweepstakes. In order to accept a prize, you shall be required to sign a release that grants permission to the Sponsor and Petzbe to use your name, your pet’s name, your or your pet’s photograph or likeness, prize information and/or biographical information without future compensation unless prohibited by law. By entering this Sweepstakes, you acknowledge and agree to release and hold harmless the Sponsor and Petzbe, Inc. and their its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damages of any kind arising from or in connection with the Sweepstakes, Sponsor’s website, Petzbe App, or any prize won.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND PETZBE, INC. AS A RELEASED PARTY HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. 6. Secret Life of Pets 2: Bespoke Poster Prize. Prize Supplier is providing PETZBE with the below listed prize(s) for this Sweepstakes subject to the following terms and conditions:
Prize Description: An exclusive The Secret Life of Pets 2 poster featuring your pet. For the Prize Supplier to provide the Prize, they require Winner(s) to provide the following:
(i) Four (4) high resolution and clear photos of the Winner’s pet.
(ii) The name of the Pet
(iii)The gender of the Pet
Prize Supplier’s Terms and Conditions are fully incorporated in these Sweepstakes Rules. All prizes are subject to the following:
a. All prizes are subject to availability.
b. The Prize Supplier reserves the right to substitute any prize with a prize of equivalent value.
c. Anything not specified in these terms and conditions as being included in the Prize is excluded.
d. No cash alternative is offered for any Prizes.
e. Prizes are non-transferable and non-refundable.
f. Winner(s) cannot change, vary, substitute or exchange the Prize. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Prize Supplier. No cash or other prize substitution permitted except at Prize Supplier's discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all income or other taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Petzbe and NBC Universal to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
g. Prize Supplier is merely providing Petzbe with prize(s) for Sweepstakes and disclaims any liability for how the Sweepstakes is run or be deemed to be a co-promoter of any kind.
h. The Prize will be delivered to the Petzbe within 4 weeks from the date in which the Prize Supplier receives the Winner’s photos, name and gender of the pet. The Prize Supplier will also provide the artwork file for the Pet too. Petzbe will determine format(s) for Prize delivery to the Winner (framed/physical/digital etc.).
i. Prize Supplier does not need any personal data of the Winner. The Prize Supplier will provide the Prize to Petzbe.
7. 8. Odds: The odds of winning depend on the number of eligible entries received during the Promotional Period. Limit one (1) per person, family and household.
9. Winner selection and notification: One (1) Winner of the Sweepstakes will be selected in a random drawing. Winners will be notified via email to the email address they entered the Sweepstakes by April 29, 2019. Within 48 hours of notice, Winner must provide the following information: name of pet, gender of pet, and four (4) clear hi-res photos (see reference photos here). Petzbe shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings, for winners' provision of incorrect information, or otherwise non-functioning contact information, email service or internet connectivity. If the selected Winner cannot be contacted, is ineligible, fails to claim the prize within 48 hours from the time award notification was sent, prize notification is returned as undeliverable, or Winner fails to timely return a completed and executed declaration and releases as required, Prize may be forfeited, and an alternate Winner selected.
10. Restrictions. The Winner is fully responsible for any and all applicable taxes (including, without limitation, income and withholding taxes). All costs and expenses associated with Prize acceptance and use not otherwise specifically declared as being included as part of the Prize including, without limitation: any ground transportation to or from Prize pickup location; gratuities; taxes; tips; or any other expenses of a personal nature, are the sole responsibility of Winner. Winner must execute and return to Petzbe an Affidavit of Eligibility/Release of Liability, Publicity (“Affidavit”) and any required tax forms within ten (10) days of receipt from Petzbe. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected. Except as expressly noted in these Official Rules, the selection of all vendors, prizes, products and services is subject to Petzbe’s sole and absolute discretion. Prize (including any portion thereof) is nontransferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted except that Sponsor and Petzbe retain the right to substitute a prize (or any portion thereof) with one of equal or greater retail value or at Sponsor's or Petzbe’s election, the cash value of the applicable Prize (or any portion thereof). Additional restrictions may apply.
The receipt by Winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all applicable laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AS DETERMINED IN SPONSOR'S OR PETZBE’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
11. Rights Granted by you: By entering this contest you grant an unlimited, perpetual, and unlimited license to Petzbe, anyone acting on behalf of Petzbe, or its respective licensees, successors and assigns to use all images and content submitted via the Petzbe App or in connection with the Sweepstakes, including the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
12. Terms: Petzbe reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Petzbe may select the recipients from all eligible entries received prior to or after (if appropriate) the action taken by Petzbe. Petzbe reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes, website, Petzbe App, or violates these Rules.
Petzbe has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.
Petzbe assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Petzbe is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Petzbe reserves the right to seek damages from any such person to the fullest extent permitted by law.

13. Limitation of Liability: By entering you agree to release, indemnify and hold harmless Sponsor and Petzbe and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
14. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND NEW YORK STATE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES, except that the United Kingdom’s Gambling Act of 2005 shall govern legality and compliance of the Sweepstakes as offered to entrants within the United Kingdom. Except where prohibited by law, as a condition of participating in these Sweepstakes you agree that any and all disputes, claims and causes of action that cannot be resolved between the parties and causes of actions arising out of or connected with the Sweepstakes (collectively, “Claim”) shall be resolved individually, without resort to any form of class action, exclusively by binding arbitration for full and final settlement of such Claim, and judgment on the award rendered in the arbitration may be entered in any court having jurisdiction thereof. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. The parties shall split the costs of arbitrator and mediator fees. An award rendered by the arbitrator(s) may be entered and confirmed by the courts of the State of New York, County of New York, or the United States District Court for the Southern District of New York. The parties agree that any post-arbitration action seeking to enforce an arbitration award or action seeking equitable or injunctive relief shall be brought exclusively in the courts of the State of New York, County of New York, or the United States District Court for the Southern District of New York.
